Terms of sale

These terms govern every sale of products by Lumbee Advanced Medical Supply LLC (“Lumbee Advanced Medical Supply”, “we”), whether placed on this site, accepted from a quote, or submitted on a purchase order. By placing an order you agree to them. Where a signed agreement, a government contract or an awarded solicitation contains different terms, that document governs to the extent of the conflict.

Our products are sold for use by healthcare providers, care facilities, emergency services, public agencies, schools, employers and other organizations, and by individuals where the product is appropriate for them. We are a distributor and not the manufacturer of the products we sell.

An order placed on the site, by phone, by email or by purchase order is an offer to buy. We accept it when we confirm it or ship it, whichever comes first, and we may decline or limit an order — for example when an item is restricted, when licensure cannot be verified, or when a pricing or listing error is discovered. If we cannot fill an order we tell you promptly and do not charge for the unfilled items.

Orders may be cancelled without charge until they ship or, for special-order and custom-configured items, until the manufacturer accepts the order. After that, cancellation is subject to the returns policy.

Prices on the site are in U.S. dollars, per the unit of measure shown, and exclude shipping, tax and any freight or handling. Volume pricing is applied automatically in the cart at the quantity breaks shown on the product page. Prices may change without notice; the price in effect when we accept your order applies, except where a quote fixes it.

A written quote is valid until the date printed on it and applies to the quantities, items and delivery terms it states. Quotes are based on manufacturer pricing and availability at the time of issue; if either changes materially before you accept, we will re-quote rather than ship at a price we cannot honour. Obvious pricing or typographical errors are corrected and you are given the choice to proceed at the corrected price or cancel.

Sales and use tax is calculated at checkout based on the ship-to address and added to the order unless a valid exemption certificate is on file for your account. North Carolina purchasers use Form E-595E; other states’ certificates are accepted for shipments to those states. You are responsible for any tax we are not required to collect. We accept: Credit / debit card; ACH transfer; Purchase order (approved accounts); Net terms (approved accounts); Government purchase card (GPC / SmartPay); Tax-exempt purchasing with certificate on file.

Card payments, including government purchase cards, are captured per shipment. Net terms are extended to approved organization accounts after a credit review and are stated on the account and on each invoice; invoices are due in full by the due date shown. Past-due balances may be subject to a late charge as stated on the invoice, and we may hold shipments on an account that is past due. Payment data is handled by our payment provider and is not stored on our systems; see the privacy policy.

Approved accounts may place orders on a purchase order. A purchase order must identify the buyer, the ship-to and bill-to addresses, a contact, the items and quantities, and, where one exists, our quote number. Orders placed on a purchase order are held for approval and credit review before they are processed.

Pre-printed or standard terms on a purchase order that conflict with these terms do not apply unless we accept them in writing. Government purchase orders and contract awards are governed by the terms of the solicitation or contract they are placed under.

Orders ship from Robeson County, North Carolina, by the carriers and services described in the shipping policy, which forms part of these terms. Transit estimates are not guarantees unless a delivery date is written into a quote or contract. Title and risk of loss pass to you on delivery to the ship-to address; we file carrier claims for shipments damaged in transit that are reported within the window stated in the shipping policy.

Returns are governed by the returns policy, which forms part of these terms: unopened, resalable items within 30 days of delivery with a return authorization, and no return of sterile, dated, refrigerated or custom-configured items once the sterile barrier or cold chain is broken.

Some products are prescription devices or are otherwise restricted to licensed purchasers. These are marked on the product page. We verify a valid practitioner order or facility licence before such items ship, and we may ask for documentation at any time. By ordering a restricted item you confirm that you or your organization is authorized to purchase and use it under the laws that apply to you, and that the product will be used in accordance with its labelling.

Product descriptions, specifications, regulatory details and documents on this site are reproduced from manufacturer information and are provided for identification and procurement reference. They are not clinical, safety or regulatory advice. Manufacturers change packaging, configurations and revisions; always follow the manufacturer’s current labelling and instructions for use, and confirm a product’s suitability for your protocol and jurisdiction before use. Product images are representative.

Products carry their manufacturers’ warranties, which we pass through and help you claim. Lumbee Advanced Medical Supply makes no warranty of its own. To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Some jurisdictions limit these disclaimers; where they do, they apply only to the extent permitted.

To the fullest extent permitted by law, Lumbee Advanced Medical Supply is not liable for indirect, incidental, consequential, special or punitive damages, or for lost profits or revenue, arising from a sale or from the use of a product, and our total liability for any order does not exceed the amount you paid for the products in that order. Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence.

These terms and every sale under them are governed by the laws of the State of North Carolina, without regard to its conflict-of-law rules. Disputes are brought in the state or federal courts located in North Carolina, and you consent to their jurisdiction. Sales to government entities remain subject to the disputes procedures of the applicable contract or statute.

We may update these terms; the version in effect when we accept an order applies to that order. The date at the top of this page shows when the terms were last updated.
